General Terms and Conditions of the Lessor for the Rental of Bicycles, Electric Bicycles, and Accessories.

 
I. General Conditions and Provisions

The general conditions specify the terms under which the rental item will be made available for temporary use by the contractual renter. By signing the Rental Agreement, the renter declares that they had acquainted themselves with the terms of these general rental conditions before signing the Rental Agreement, has no objections to the wording of these general conditions, and fully agrees with them. The renter further confirms that the rental item, as specified in the Rental Agreement, was received from the lessor in proper condition without any apparent defects and damage. The renter also confirms that the lessor has properly instructed them on how to use the rental item.

II. Rental Price and Deposit

The contractual parties have agreed that the rental price for the use of the rental item is determined depending on the /duration of the rental relationship by agreement based on the rental contract. The renter undertakes to pay the lessor the agreed amount for the rental of the rental item in cash or by credit card upon taking temporary possession of the rental item, or in advance on the basis of an issued advance invoice. In case of an extension of the rental, based on the agreement of the contractual parties, the renter will be charged rent determined according to the duration of the rental extension, which will be specified in the rental agreement. The lessor may use the deposit to the extent involved to cover any additional rent due. The renter is required to pay, along with the agreed rent, a deposit to the lessor in the amount that will be recorded in the lease agreement. The deposit may be used to secure any potential obligations of the renter arising from the rental agreement. The primary use of the deposit is to offset rent beyond the contractual period. Another possibility for using the deposit is to pay for repairs arising from damage to the rental item caused by the renter. The lessor commits to returning the paid deposit to the renter immediately upon the return of the rental item either in full or in the amount reduced by claims of the lessor, which may arise especially due to damage to the rental item or as a result of breach of duties by the renter arising from the Rental Agreement.

The renter acknowledges and agrees that if during the rental period there is any damage, destruction, or theft of the rental item or any other damages caused by its use (including any damages caused to third parties), the lessor bears no responsibility and compensation for such damages is entirely the responsibility of the renter.

III. Obligations of the Contractual Parties

The lessor is obliged to deliver the rental item to the renter for its temporary use in proper technical condition, enabling utilization of the rental item for the period agreed in the rental contract. In case of a technical breakdown, the renter is immediately obliged to contact the lessor in order to agree on the procedure for removing the fault. The lessor will hand over and, after the agreed period has passed, take over the rental item from the renter at the addresses according to the agreement, unless the contractual parties verbally agree otherwise. The renter undertakes to use the rental item exclusively for recreational purposes, use in competitions and performance events is not allowed. The renter is further obliged to use the rental item in such a way as to not cause damage to the rental item or its excessive wear. The renter is required to protect the rental item not only from damage, loss, or destruction, but is responsible to the lessor for any damage, loss, and decrease in value of the rental item in full, regardless of the extent of fault by the renter. The renter is solely responsible for any damage to the rental item caused by a person to whom the renter entrusted the rental item, as if they had damaged the rental item themselves. The right to use the rental item expires upon the expiration of the period for which the contract was concluded. The renter is required to secure the rental item against theft. In case of theft of the rental item, the renter is obliged to immediately report this fact to the Police Force of the Slovak Republic for the purpose of writing up a protocol on the reported theft. The renter is further obliged to immediately inform the lessor about the occurred situation by phone. In the event that during the term of the rental relationship, there is a loss, theft, or destruction of the rental item such that the rental item becomes unusable, the renter agrees to pay the lessor the full price of the rented item listed in the contract within 7 days from the day of the loss event or theft. Upon paying the full amount for the rental item, all rights to the item pass to the renter In case of a delay in returning the rental item, a charge of 50 EUR for each started day will be invoiced until the rental item is returned to the lessor. The renter acknowledges that they are obliged to comply with all rules and regulations of road safety and traffic flow when using the rental item. Furthermore, they acknowledge that for violating the safety rules and traffic flow regulations, or for damages to property and health of third parties, which occurred in connection with this violation and operation of the rented item, they are solely responsible. They are also responsible for any damage caused by third parties using the rental item entrusted to the renter by the Rental Agreement.

IV. Termination of the Rental

The Rental Agreement terminates upon the expiration of the period for which the rental was agreed. The lessor has the right to withdraw from the Rental Agreement and demand the immediate return of the rental item even before the expiration of the period for which the rental was agreed, especially if the lessor is not using the item properly, in accordance with the purpose it is meant for.

V. Final Provisions

The mutual rights and obligations between the lessor and the renter are governed by the Rental Agreement, these General Terms and Conditions, the Civil Code, and other valid legal regulations of the Slovak Republic.
